ACCEPTANCE OF TERMS

By booking any of our travel services, the client declares that they have read, understood, and accepted these Terms and Conditions.
These terms form an integral part of the service contract between the client and Nickey Travel.


RESERVATIONS AND PAYMENTS

  • All reservations must be made in advance and are subject to availability.

  • To confirm a reservation, the client must provide:

    • Full name

    • Nationality

    • ID or Passport number

    • Email address

    • Phone number

Initial Payment Requirements:

  • 50% for domestic travelers.

  • 40% for international travelers.

Payment Methods:

  • Remaining balance must be paid at least one day before the start of the tour.

  • Payments may be made in cash, by bank transfer, by check, or through authorized digital payment platforms.

  • Card payments carry an additional 5% surcharge.


CANCELLATION AND REFUND POLICY

All cancellations must be submitted in writing via email or an official message.

Penalties based on notice period:

  • More than 30 days prior: 70% refund.

  • 15 to 29 days prior: 50% refund.

  • Less than 14 days prior: No refund.

⚠️ Non-refundable tickets: For services such as train tickets, Machu Picchu, Huayna Picchu, flights, etc., the client assumes 100% of the cost.

⚠️ No-shows: In the event of failure to appear (“No Show”), no refund will be granted.


MODIFICATIONS REQUESTED BY THE CLIENT

  • All modification requests are subject to availability and may incur additional costs.

  • Requests must be made at least 7 days in advance.


MODIFICATIONS DUE TO FORCE MAJEURE

Nickey Travel reserves the right to modify, reschedule, or cancel services for reasons beyond our control, such as:

  • Extreme weather conditions

  • Strikes or protests

  • Closure of archaeological sites

  • Natural disasters

  • Other exceptional circumstances

In such cases, we will seek an equivalent alternative, but full refunds will not apply.


CLIENT RESPONSIBILITIES

The client is responsible for:

  • Having valid and up-to-date travel documents (ID, passport, visa, etc.).

  • Informing the agency of any medical conditions, dietary restrictions, or other relevant considerations.

  • Following instructions, schedules, and rules set by the tour guide or agency staff.


AGENCY RESPONSIBILITIES

  • Nickey Travel acts as an intermediary between the client and service providers (transportation companies, hotels, guides, etc.).

  • We are not responsible for losses, accidents, damages, or delays caused by third parties or force majeure events.

  • We commit to delivering a professional, safe, and high-quality service, except in justified exceptional cases.


USE OF IMAGES AND AUDIOVISUAL MATERIAL

By participating in our tours, the client authorizes Nickey Travel to take photos and videos during the trip for promotional purposes, unless the client explicitly requests otherwise in writing before the start of the tour.


PERSONAL DATA PROTECTION

Nickey Travel guarantees the confidentiality and security of personal data provided by clients, in accordance with Peruvian Law N.º 29733 (Personal Data Protection Law).

Data collected may include:

  • Full name

  • ID/Passport number

  • Nationality

  • Email address

  • Phone number

  • Travel preferences

Use of personal information:

  • To confirm reservations

  • To deliver contracted services

  • To issue invoices or receipts

  • To send relevant travel information

Data protection measures:
We implement technical and administrative safeguards to ensure data security.

Data sharing:
Personal data will only be shared with:

  • Essential service providers (hotels, airlines, operators, etc.)

  • Legal authorities, when required by law

User rights:
Clients may request:

  • Access to their personal data

  • Rectification of incorrect or incomplete data

  • Deletion of data no longer required

  • Restriction of data processing

COMPLAINTS AND DISPUTE RESOLUTION

  • Complaints must be submitted within 48 hours after the service has been provided.

  • Nickey Travel maintains a physical and virtual Complaints Book.

  • The agency will respond within a maximum of 15 business days.


JURISDICTION AND APPLICABLE LAW

These Terms and Conditions are governed by Peruvian law.
In case of any dispute, both parties agree to submit to the jurisdiction of the courts of Cusco, Peru.


IMPORTANT NOTICE BEFORE BOOKING

  • Before making any payment, availability must be confirmed.

  • Nickey Travel will not be responsible for payments made without prior verification of availability.


BOOKING – REQUIRED INFORMATION

To confirm your reservation, please provide:

  • Full name(s)

  • ID or Passport number

  • Name of the chosen hotel

  • Flight itinerary (for transfer scheduling)

  • Arrival and departure dates (Check-In / Check-Out)


SPECIAL CANCELLATION AND CHANGE POLICIES

  • For confirmed bookings, refunds are subject to hotel policies and applicable government regulations.

  • Cancellations within 72 hours before the trip: 70% of the total amount will be charged, or the booking may be rescheduled according to provider policies.

  • No-show: 100% of the paid amount is non-refundable.

  • Itineraries may be modified due to force majeure (strikes, extreme weather, etc.) to ensure traveler safety.
